Definition Of Adoption..
« on: Tuesday 07 March 06 15:06 GMT (UK) »

Hello,
When my  GGGgrandfather left Scotland he left his daughter behind. Her  mother had died when she was still a baby.
Anyway,i have spotted her in the 1861 Census as part of another  family and she is enumerated as an adopted daughter. Is that likely to mean that they literally adopted her or something else?In the english censuses i found an illegitimate child with her mother and step-father and she was enumerated as  a daughter-in-law so i thought i ought to ask before i jumped to any conclusions?I know it was a long time ago but was there any procedure for this and if so where should i be looking..Thanks alot..

Legal adoption did not exist at that time. Adoptions were informal and usually happened within the extended family. Her adoptive parents might have been an aunt and uncle - the aunt being her mother's sister. other normal adoptive parents were the grandparents, on either side. These "adoptions" are often valuable clues that permit a step backwards in time.

In those days daughter in law was a strict relationship which recognised that by marrying her mother the new husband had become her legal father; in fact her father in law.

The terms step father and step daughter were not used.

The relationships which we now refer to as father in law and daughter in law were simply father and daughter.
