I've got a copy of a newspaper article relating to the death of a gggg grandfather in 1866 from the Scotsman(the same article also appeared in the local Falkirk paper). I would like to include it in some form on my website either  a copy of the article or as a transcription. Being so old I would imagine the author's copyright on the article has lapsed but as it appears in the Scotsman digital archive(where you need to pay a fee in order to access) I was wondering if any copyright issues might come up due to that? Had a look on the Scotsman website but can't find anything relating to it.

I think you will find that there are issues.  This is the link to the Copyright Notice on the site:

Got in touch with the Scotsman and they gave me permission to transcribe the article as long as I gave a link to their archive page. It's now on my website!!
