Can anybody tell me where to access records of divorce in Alverstoke in 1850/1860? Thanks a lot.

Hi Angela,

Divorce at that time was very rare.  Until 1857 divorce as we understand it today was ONLY available by private Act of Parliament.  This made it expensive and beyond anyone outside the upper echelons of society.  Only 318 divorces are recorded prior to this date and the copies of the acts are at the House of Lords records office.  Only four women successfully petitioned for divorce.

Church courts were available to aid divorce prior to 1857 - an annulment might be granted and remarriage could take place.  Separations were possible but  remarriage was then impossible.

From 1 Jan 1858 divorces could be granted e.g. for adultery.  However, this was usually the wife's adultery.  Until 1925  a wife had to prove her husband's adultery AND cruelty or other offences.

The National Archives holds the records of divorce actions from 1858 - 1937. (Class J77) and there is an index in class J78.
