France: Legal To Marry?

Was it legal for a man to marry his sister's daughter (niece) in 1839 in France?

Everything fourth-degree of consanguinity or less (first cousins or closer) was prohibited under Catholic law. Dispensation might be given for first cousins to marry (and often was in some years), but probably not for anything closer as that would come into conflict with civil laws regarding marriage.

I'm 99% sure I've got things right though.

In french civil law it's impossible
this text in French is clear about the law ... forbidden between uncle and niece and even between great uncle and great niece. However under somes circonstances there can be a special authorisation from the President of the republic

La consanguinité (articles 161, 162 et 163 du code civil). Que la parenté soit légitime ou naturelle, le mariage est ainsi impossible : en ligne directe entre ascendants et descendants, et les alliés dans la même ligne; en ligne collatérale, entre le frère et la sœur, ainsi que pour les alliés au même degré; entre l'oncle et la nièce, entre la tante et le neveu et, de jurisprudence, entre le grand-oncle et sa petite-nièce. Il s'agit ici d'une prohibition d'ordre public. Toutefois, le président de la République peut, pour des motifs graves accorder une dispense pour les mariages entre allies en ligne directe si la personne créant l'alliance est décédée, à ceux entre beaux-frères et belles-sœurs et à ceux entre oncle et nièce ou tante et neveu (article 164 du code civil).

It did turn out in the end that I had two people with the same name, yet seemingly unrelated (as far as their parents/grandparents lines).
I do so wish English marriage records held as much info as the French ones.
