Second Marriage
« on: Tuesday 05 May 09 11:27 UTC (UK) »

Absolom Cornwell married 1) Elizabeth Moule Brignell in 1881 2) Esther Cornwell in 1901. Esther was the niece of Elizabeth. At that time I believe such a marriage was illegal, am I correct, and if so is this still the case?

Since 1931 marrying your deceased wife's niece is not within the prohibited degrees of relationship (in England and Wales - I don't know about anywhere else).

Absolom Cornwell would appear to have been breaking the law in 1901.

My great great grandfather married his deceased wife's neice in 1850-they lived in a small village and everyone must have known of the relationship.

I thought that was the case, and it would appear that from cases I know of in Lincolnshire in the 19th century, again in small villages that the law was just flagrantly disregarded.

My great great grandfather had had three children by his first wife's niece by the time they got around to getting married . According to family legend the local vicar practically ordered them to get married although the marriage actually took place in the local baptist chapel.

Hi Scaramoosh and welcome to Rootschat. Interesting that there must be a connection between us. The Ayres/Cornwell/Brignell tree in that area is so intertwined that there is likely more than one connection. Was your great grandmother Elizabeth Moule Brignell or Esther Cornwell?

Hi Redroger,

My great grandmother was Esther Cornwell, they also had a daughter by that name aswell which is one of my grandads sisters.
I never realised that Absolom had been married before,so that piece of info is quite interesting.

Hi Scaramoosh, I have a fairly extensive tree on the Ayres/Cornwell etc. family. If you would like a copy please send me an email address by PM. It's in Legacy 7 format, if you would like it as a GEDCOM please say. When you have made 4 postings then you can send personal messages.

Hi Roger,

Thanks for that.

Just had alook at the info i have regarding Absolom Cornwell.
It appears my Grandad Albert Cornwell was born in 1899,so Elizabeth Brignell could have been his mother and not Esther Cornwell as first thought.
Any idea when Elizabeth died?

Married Esther 22 June 1901, so Elizabeth should have died earlier than that.

Just checked with my mother and she said her father Albert Cornwell had a step-mother who was Esther.

Something to look for on this, it was all too common and you will find some instances in the tree, i.e. mother of Melinda Brignell d c1880. She (Melinda) was my grandmother, and her grandmother died in childbirth. If you look on the photo restoration thread, or better search for Ayres/Brignell wedding 1896 you wll find Melinda as the bride, the old lady on the right hand side of the picture is Sarah Willis, nee Moule, my 2great grandmother, and her grandmother.
