Will and estate of ggg grandfather.

I've found an entry in the London Gazette on 8/7/1879 regarding my ggg grandfather's estate. The strange thing is that he died in 1864. Why would it take 15 years for the solicitors to post this entry asking for anybody with a claim against his estate to come forward? Also, when I try to find the will, which date should I be looking under? As far as I can tell, there aren't any peculiar circumstances, as his eldest son took over his business and ran it for several years. All the other entries on the page died within a year or so of 1879.

If you think 15 years is a long time, have a look at Lady Di's scavenger hunt, her rellie died in 1846, the admon wasn't proved until 1901, 55 years later  Shocked

There could be many reasons for the probate taking so long to be proved, I'm sure that some Rootschatters can give you some.

Here's one from my own family experience.

Maybe a part of the will was to do with the business, and there wasn't enough money in the business for the will to be executed.

If you have access to the probate calendars (there is a full set at Holborn and a partial set on microfiche at Kew) you should check from the date of death in 1864 until you find the correct entry which may not be in the calendar until 1879 or even later.

Golly Dawn, after 55 years most probably the beneficiaries will themselves be dead!

The delay is often as a result of the fact that many relatives do not prove the will unless and until there is a need to do so. If a beneficiary continues say to live in the house of the deceased they may feel no urgency until they want to sell the house years later and then realise that the house cannot be sold until a grant of probate is taken out. It is the Grant that gives power to the executor to act. No one would buy a house of a deceased person unless the 'vendor' had the legal power to pass title.

There may of course be many other reasons for delay

Thank you James. I think this is the likeliest reason for the delay as the eldest son is in the census before his father's death running the business from his father's address, and again in 1871, but not in 1881.

It may very well be because a will was not left (or if left ever proved) and there was only an administration taken out in 1879 possibly on the death of his son? The will and administration yearly indexes held by the probate service, since the majority of the population did not leave wills or administrations, are relatively quick to search.
