Hi,
I am researching Philip Blunt b. 1822 in Hewelsfield.
In 1842 he was sentenced to 7 years transportation. I am trying to find out if this sentence was actually followed through and Philip Blunt was actually transported or if his sentence was changed.
I'm from New Zealand so I can't go to the records office myself ... I can find the reference number from the Gloucester Archives Database though if that's any help
If anyone might be able to help, I would really appreciate it

Hi Chas,
That is very interesting because I don't think that Philip Blunt was actually transported. He is still around in 1851 census although he doesn't have any children but looks married (although I can't find marriage record) and I think that it was rare for people to return to the UK after serving their sentence.
I was wondering if the sentence somehow got changed ... That's why I wanted to see if someone could do a lookup for me for Philip Blunt in the Gaol records to see if there is any mention of a sentence change.
Does anyone know if there is some kind of list of transportee's from Gloucestershire? Someone mentioned that the Family History Society might have one

I'm going to the Archives this afternoon and will take a look at the Gaol Records for Philip Blunt for you.
The FHS is on the same site, so I will ask about the transportees list you mention.

I found Philip in the Gaol Records. You might like to hear the details:
Appearance: Brown hair, hazel eyes, common complexion, mole on left breast, pock pitted. N (usually means unable to read or write) Height 5 ft 5 3/4 ins. Labourer. Residence Hewelsfield Charged on the oath of Samuel Edwards with feloniously stealing at Hewelsfield on the 9th Jan instant 3 buckets of wheat and 2 loaves of bread, the property of the aforesaid Samuel Edwards. Adjourned sessions sentenced March 4th 1842. Transported 7 years Conduct orderly Magistrates C Bathmore Esq & E Machen Esq
The archivist referred me to a book called "Transportees from Gloucestershire to Australia 1783-1842", which lists all the transportees with their place of residence, occupation, length of sentence and the name of the ship and date on which they set sail. Apparently they would first be sent to Australia before going on to Van Diemens Land, Tasmania or New Zealand.
The big "however" is that some were not actually transported, but either had their sentences commuted or served them on the prison hulks on England, where in any case they were assessed to see if they would survive the journey, in other words whether it was worth paying their passage. Chas, this probably applies to your relative, don't you think?
It looks as though your Philip stayed in England after all, because his name did not appear in the list of transportees.

I'll take another look at that list of Transportees to see if John (William) Weyman is there. Do you have the Gaol Record in full? I'll check that, too.

I've been thinking that since it doesn't seem likely that Philip Blunt was transported ...
How would I go about finding out what did happen to him?
Is there any Gaol registers that I would need to search to see where he went etc?

It's unfortunate that the list of transportees ends in 1842 - there's no list for any following years, and it's possible that the process of arranging transportation could have taken some time. However, the fact that you have found Philip in the 1851 census in England seems pretty conclusive. You say that he was married - what does the 1851 entry say? Is there any mention of his wife and family? Where was he living and what was his occupation? Could you transcribe the entry for us?
I'm not sure where you could go from here. In Chas's relative's record the name of the prison hulk was given, but not in Philip's case.

Gaol Records show both William Weyman aged 55 from Olveston, who was tranported on the 20 Dec 1841 on the ship Somersetshire, and John Weyman 35 of Stinchcombe, who as you say was on the hulk Justitia in August 1842.
William was a 6 ft tall ex-serviceman who had served 22 years with the 2nd Batt Royal Artillery, though at the time of the trial he was a plumber and glazier. He shot and killed a man and was condemned to death, but had the sentence commuted to transportation for life. He was sent first to the hulk Warrior at Woolwich.
As you say, your John Weyman was sent to the Justitia hulk with a sentence of 7 years transportation. He did not appear on the list of transportees, though the same caveat applies to him as to Rebecca's relative, namely would he have been transported before December 1842, when the list ends, or might he have still been on the hulk awaiting transportation at that time? William was tried in September and transported in December, so a couple of months elapsed between his trial and his deportation.
I don't know if you have the details of John Weyman's records in full, but will send them to you in a PM, if you wish.

There is a marriage of Philip Blunt and Eliza Jones, bachelor and spinster of the parish of Bishton, Monmouth, on 20th Oct 1846 both in the IGI (though it's a member's submission) and more conclusively in a transcription of Monmouth registers. Neither father's name was given. Both made their mark and the witnesses were James Davies and Esther Rosser, who both signed.

Bishton is only 20 miles away from Hewelsfield, and the date is about right, so it's a possibility, don't you think? Could be confirmed if you found Philip and Eliza together in the census.
