hi all

general enquiry, one of you is bound to have the answer.

Know that in years past divorce was too expensive for most 'ordinary' people, so they just disappeared and married elsewhere.  If the marriage was exposed as bigamous to the female half of the union, what was her legal status?

Would she still be Mrs 'whoever' or would/could she revert back to her maiden name?

What name would she have to give say on another marriage cert or what would have to be put on her death cert?

all help very gratefully received

The marriage would be invalid so she would be single.

Legally, that is correct.

However, we have a case in the 1800's where a young woman's husband received a long prison sentence. She "married" two other husbands, each time using her first married name and giving her correct maiden name. Her marital status was not stated on the second "marriage", but she presented herself as a widow at the third "marriage".

After having 1 child to each of the first 2 "husbands", the third union produced 9 children, and the "mother's maiden name" varied between all 3 former names.

Her second "husband" remarried, presenting himself as single.

Her first, legal husband also remarried after his release, also presenting himself as single.

There were NO divorces between ANY of the parties (Two should have occurred, I think).

The amazing thing is that she continued to live within the same general (rural) area.

This is probably an extreme case, but I suspect that in practice, a lot of people either ignored the original legal marriage and pretended to be single, or, particularly if there were children, became "widows".

I have a case where a relative was married in 1832, 3 days after he had committed a highway robbery for which he got life transportation. His wife moved, and after a few years had 2 children with another man, the children were named with her married name (Luffman) and never used their biological father's name (Hewitt) even though they were well aware of it. On the children's baptisms the vicar wrote "Her husband was transported sometime back"
