I expect this has been asked before but anyway.....
I have an ancestor who was born illegitimately, I have his birth certificate and his name is Charles Bradley (mothers name Charlotte Bradley - no one named as father). Several years later his mother married Jeremiah Murphy and from then on Charles and his older sister took the name Murphy.
I have Charles marriage certificate and on it he gives his name as Charles Murphy, father is Jeremiah.
Was this commonplace when 'adoptions' weren't formalised? I just thought that with a marriage certificate being a legal document he should have given his name at birth rather than the name he was known by.
Not massively important, just interesting.
Thanks
Kim

I think that as long as there's no intent to defraud you can call yourself whatever you like.
In this instance, depending on how old he was when Charlotte and Jeremiah married he may well have thought that Jeremiah was his father or he may have put Jeremiah as his father to keep up appearances.
My nana was also illegitimate, she was registered under her mothers surname Wilson but married as Brown, the name of her adopted family.

I think (and if I'm wrong some one will put me right) that legally you had to use the name you were currently known by at the time of marriage.

I believe it is not absolutely essential to carry out any procedure to change surname, though it can save time and questions in the modern world.

Charles was 5 when his mother married and his sister 7 so I would imagine they both knew that Jeremiah wasn't their father but you've answered my question.
Thanks to all for your input - much appreciated.
