Hi Board,
I am researching an ancestor that was tried at the Derbyshire Assizes in 1800/1. Stephen Wain/e was charged with stealing money from Joseph Webster of Chesterfield. There are three references to the case in The Derby Mercury on 5th. March 1801, and there are also references in the 'Mercurys of 26th. March and the11th. of June.
I am looking for either the original court records or more information from the Newspaper articles as all I can get access to is the mentions from other researchers who are not willing to share the exact details. Any help would be exceedingly appreciated!!!! Regards Sandi Megson

I haven't received them as yet...although i have paid for them.....i haven't even had an answer back from the "magic attic" who i requested them from....!!!!! I would LOVE any details you could get for me!!!

I would also like to know where you got the information that Stephen was 19 at the time of his arrival here. According to all research I have done nothing was mentioned regarding his age but the concensus from family geneologists is his age was approximately 30 years old???

Yes I'm in Queensland. I will endeavour to get the book, but from all of the research ever done, there isn't any surviving record of Stephen Waine's age or year of birth. The trial data is also missing for the month/year he was convicted.

Yes, most of the information is correct. However, Elizabeth Mandeville was born approximately 1791. (Apparently she may have been a native of London according to the Doctor's statement made at the inquest into her death, but it's not written in stone as many flocked to London to better their lives).... .....also their children WERE NOT TWINS, I don't know why people keep insisting on perpetuating that myth. Every census and muster taken between 1811 and 1828 put their ages as 3-4 years apart. Mary Wayne (Murriel) used her brother's date of birth to marry Richard Beauchamp, (I think) because both her parents had passed away and William Wayne couldn't afford to take care of her. Plus the fact that in 1828 she was listed as 16 years old and a servant of Mr Beauchamp at Bathurst. She was infact (according to the censuses) only 13 years old when she married Richard Beauchamp as the census taken in 1825, says she was only 10 years old. However, in the census of 1828, she suddenly jumps to 16years old. (Mind you the very same age as her brother William)...The other thing to note is that her month of birth had to be before his, as one year she is only 3 years younger...the rest of the musters she is 4 years younger....I would hazard a guess that she was infact born in 1815. William in the 1825 muster was listed as 14 years old, which is about correct if the muster was taken before august, he would not yet have turned 15years old. William also married twice, First to Lydia Ann Halloran as a common wife (not legally married) and had two children. The second was indeed Ann Miller. Elizabeth Mandeville died on the date you stated in Cambridge street, The Rocks. She died 12 hours after collapsing in the middle of the street...(according to witnesses she was intoxicated) I took her inquest to my local doctor and he stated that in today's modern medicine, she would have been diagnosed with either pregnancy diabetes (her breath didn't smell of alcohol, however her words were slurred) perhaps indicating a seizure, or pre-eclampsic toxeamia.

According to Elizabeth's court records your dates are correct....most family members searching have put it at 1791...dunno why....LOL.....Stephen was 30 years old when he arrived in Australia according to the book "Transportation and Chains - The history of the Beauchamp and Vane Families"......but I have estimated that he would have been younger than that....who knows until i can get hold of the assizes or there is more information in the newspaper reports in the Derby Mercury.
Thanks for your interest and your help I am also researching Johnson, Bartlett, Wallace families too.....

Dear Sandra, Not much personal info but this what I found. Derby Mercury. 5/3/1801 Commited to the County Goal, Stephen Wain, charged with stealing from the person of Joseph Webster of Chesterfield 18 Guineas and 7 shillings in gold. ---------------------------------------------------------------- 26/3/1801 Stephen Wain for stealing 18 Guineas and 7 Shillings was ordered to be transported for a term of 7 Yrs. ---------------------------------------------------------------- 11/6/1801 On Sunday 7th June, were safely delivered on board the Laurel prison ship in Portsmouth Harbour the undermentioned convicts for transportation from our County Goal till their several sentences shall be carried into execution. Stephen Wain,William Wragg, Francis Biddle {Alias Biddulph} William Smith, Robert Sherwin and William Gillman for the term of 7yrs each. -----------------------------------------------------------------
