Hi everyone,

I was wondering back in the late 1800's early 1900's who would have wills?   If you had no money, would you bother with one?  Was it just something for the rich in those days? 

Any thoughts?

I have found some Wills on ScotlandsPeople for my ancestors 1800-1900. They seemed to have inventory between 500 - 1000 pounds and were listed as property tennants (although my understanding of Scottish land ownership of that time is not good) so they may have "owned" their properties.

In 1800s Australia I have wills or intestate proceedings where there was virtually no property or personal estates (one was worth 65 pounds).

Wills may be harder for our ancestors to find, when my mother died recently, because her estate was small & most was in joint ownership with my father, no probate was required. I don't know when this "non requirement" came into effect.

Hi Trish:

Yes, you can find wills where the person did not leave a lot of money but they had belongs. I have the will from 1857 for my 4xgrgrandmother. She did not leave any money but she left her belongs to her children. Like her feather bed. another thing that is good about wills it that you can find family members. Plus wills are very interesting to read as well even if they are not your family members.

Hi Anne & Karen

Anne has just reminded me of another will I have, the lady had virtually nothing (her husband had previously died and left everything to the children) so the will simply mentioned about 10 small personal items left to her children & friends. Very useful for finding who the ladies in the family married.

Thanks for the information.

Now, I know how to go about getting copies of wills here in Ontario, Canada, but for the UK, how would one go about checking?

For instance, I have many family member who died in Birmingham, England, so would I start with the City of Birmingham archives?

What about Ireland?

No, certainly not just the rich, pratically every class of society left wills though having said that many people did not.

Prior to 1858 in England the Church courts dealt with wills. These should be held at the County Record Office
After 1858 wills were dealt with centrally by the Court of Probate, Probate Search Room, First Avenue House, 42-49 High Holborn, London WC1V 6NP

It may give you an insight, its the National Archives

Scotland is different and wills can in 50% of cases be found online (old ones)
