After reading a comment today about who can and can't marry who in Australia, I thought I'd post this link from The Attorney-General's Department.

I stated it was not legal in Australia for niece and uncle to marry.
As it turns out from Bitzar's link, I was mistaken and happy to be corrected so I will know next time should the query arise ;D

I have a couple in my family tree where a man married his wife's niece after his wife died and they had to get married in South Australia as it wasn't legal at the time in Western Australia. This was in 1931. There was no other reason for them to be in SA at the time, no family or work connections and this is what has always been said by the family through the years.

Err .... the English marriage Act of 18 July 1823 covers marriages 'abroad' ie  including what was then New South Wales.  As  from 19 July 1823 NSW had , under the Charter of Justice, authority to make its own lawful determinations including its own laws re marriage, and  with the authority of its own Supreme Court. Constitutionally 'Australia'  commences with Federation 1 Jan 1901, and of course each state continues to exercise  its own  legislative authority as per their own constitutions ...

The federal parliament from 1961 had authority to harmonise the various states Marriage Acts.
