James VIVIAN - convict to SA?

My gt-gt-gt-grandfather James Peter VIVIAN was born around 1805 or 1806. He arrived in South Australia in the mid-1840's after working as a cattle drover along the Murray River. He married Mary Ann WALLIS in 1848, and settled in the Mt Pleasant area, to have several children. Family folklore has it that he was a remittance man. He died in 1890.

There is a James VIVIAN who arrived on the convict ship Claudine in 1829 to serve a life sentence for cattle stealing. He was born in 1806, and convicted in Dorset in 1828. In 1838, he was granted a conditional pardon, and given permission to marry Catherine FORREST (b. ~1821 in Cork, Ireland).

They were married at Wollongong on 12 Feb 1839. Three children soon followed:
1. Mary Jane VIVIAN, b. 2 May 1839 at Dapto
2. Jacob VIVIAN, b. 1 July 1841 at Dapto
3. Charlotte VIVIAN, b. 4 Oct 1843 at Jervis Bay

Catherine second marriage (date unknown) is to Christopher Terry DUKE (b. 1824), from Devon. They had two known children:
1. Jemima Forrest DUKE, b. 29 Aug 1856 at Balmain
2. Christopher Terry DUKE, b. 12 Oct 1860 at Balmain

So James Vivian disappears sometime between 1843 and 1855. Is there a record of his death, or any other info post-1843? Or could he be my gt-gt-gt-grandfather?

Have you seen this ad in the SMH 12 November 1851?

"Catherine Vivian, having arrived in Sydney from California, wishes to see her husband James Vivian and Jacob Vivian, her son, formerly brickmaker, in Wollongong....  "

Also on the NLA newpaper database there are more ads in the SMH in 1854, seeking James and Jacob, and in 1862 there is one from Jacob (or concerning Jacob) , seeking Catherine.

NSW BMDs give the year for Ctherine's second marriage:
1871  DUKE  Christopher Jerry =  VIVIAN  Catherine, registered at Sydney #302

(The index entry says Jerry but I note that the birth registrations show father as Christopher T)

Do you have a birthplace for your 3g grandfather?

Odd they married so long after their kids were born.

Re the SMH adverts: Suggests that Catherine and James seperated in the 1840's, splitting the kids along gender lines, and that the whereabouts of James and Jacob were unknown. I wonder if Jacob VIVIAN shows up in SA BDM's or BISA anywhere?

James Peter VIVIAN was Cornish, as are many of my other emigrant ancestors, surnamed DAVEY, LADNER, SIBLEY, WALLIS, WAYE and WILLOUGHBY.

A Jacob VIVIAN is featured in the Dec 2006 issue of Australian Family Tree Connections (vol 14, issue 12).

Does anyone have a copy of that to do a look-up please?

There is no marriage for Jacob VIVIAN up to 1916 in SA.
There are marriages of
Edwin Wallace 1896- father James P VIVIAN
John Peter 1883- father James Peter VIVIAN
James Alma 1885- father James Peter VIVIAN
