Lavinia Brearley of 22 Mary Street, King Cross, Halifax (wife of Thomas Brearley) died 9 January 1905 at the Royal Infirmary, Halifax.  Probate Wakefield 8 February to Charles Ellison cart-driver.  Effects £17.16s.

however may have found a way around finding family for charles.

not 100% certain as yet but believe may just have found family clues for joseph ogden ellison.

joseph ogden ellison 1878 had a wife called emma jane greenwood(ellison) and believe they had a son called albert

I thought you had everything for Charles Harry Ellison 
(apart from that elusive marriage supposedly to Lavinia) which we all believe never took place

And the probate index entry confirms there cannot be a marriage of Lavinia to Charles, because at the time of her death she is "wife of Thomas Brearley" - so Thomas is still alive.

That's interesting!  I've been researching Gaths but hadnt picked up on this.  I'd not realised that Eliza and Charles had separated.   Thank you for the detective work.

The Gaths were numerous and mobile and lived in various towns in Lancashire from about 1802 until approx 1830, then moved back to Yorkshire and settled around Halifax and Bradford.
