Thank you all for your replies,  will turn the email into a letter and post it off this week and also get in contact with Stewarton Memorials and see whether they have any suggestions. With luck, as Lodger mentioned, as it is only a repair it may be able to be done without too much red tape.

Well, wouldn't you know it, just as I gave up on the Lanarkshire Council they have replied to me.
The Lair is still owned by Thomas Robertson who died 3 dec 1953 and the council have sent a form for "Application for Transfer of Lair Certificate",   so will contact the grandchildren and work out what to do next.   Maybe there is a Lawyer amongst them who knows the next step to take.

We are almost there!     :)
Contacted the council about another way to repair without getting ownership of the lair and was sent an "Indemnity Form" which takes away any blame from the Council if, in the future, a closer relative than Grandchild gets upset about the stone being repaired.  Have had a quote from Lodger's recommendation Stewarton memorials and with Don's prices as a guide we are going ahead with the restoration.  Rang Scotland last night with my bankcard number and as they normally take 6-8 weeks to renew the stones it all fits in nicely with my time in Glasgow in early July.
Will complete this thread now but add a picture, early August, of the Headstone as it was in 2012 and as it looks after the repair.
