National Probate query
« on: Wednesday 04 March 15 13:12 GMT (UK) »
Hi

I have two queries relating to the below, the first is that this is a Scottish relative who always lived and worked in Scotland, so why would he be on the England and Wales index?

Also as I thought this indicates there is a Will I have just been on the Gov.uk website where you can order it for £10.00, but on searching for him on the records with his year of death he is not coming up on the site, so am confused where to go from here.  Thanks

Have a read at http://www.nas.gov.uk/guides/wills.asp - it would appear to indicate that he owned or had interest in property or business in England

Unfortunately as this example is after 1925 it is not available online and the so called "UK National" Probate site deals primarily with England and Wales

You have to put the death date as 1958 not 1957 when he died (the date it was sealed)

People are often listed in the Irish probate calendars for the same reason. They may never have lived in Ireland but if they have assets there action is required there to dispose of these according to probate law. The abstract is usually noted as "re-sealed at Dublin" or wherever. Tells you that they lived somewhere else but had assets in Ireland.

Just a wee note that, although Confirmation may have been issued from Ayr Sheriff Court and that Confirmation sealed in England, the deceased may have left a Will but he also may not :( He may have died Testate (leaving a Will) or Intestate (without leaving a Will) and Confirmation may still have been required.
