I never thought of looking at TROVE!!!

You may have found the answer and possibly the conviction was quashed.   I shall add that extract to the biography with an appropriate qualification that it is presumed the conviction was overturned.  Are you aware of any Supreme Court records online that could be researched?

Hi All

On 4 August 1857 Sidney Stephen then the acting Chief Justice or like responded to the Governor of the days request to review the case of Walter Huntley.  The review covers legal matters revolving around Walters intent.  The judge recommended Walter's pardon.  This was obviously acted upon and it appears after about two and half years in jail Walter was released.  I cannot find in colonial reports of the time the Governor advising his masters in England of the actions he had taken.  Once this or a similar document comes to light we will have a better understanding of the timing of his release and any conditions that may have been attached.  There are also a number of petitions from settlers and maoris seeking Walters release.  The documents are available from the NZ Archives.
