I ruled out that marriage in view of the names of the children born in 1938 and 1940

I've done some further digging into the electoral register and it shows Ernest's birth as 18/12/1907 not 1898 as I thought and looks like he died in the September quarter of 1955

No middle name and unfortunately no probate application to help confirm identity

Where did you get his middle initial J from?   Could he be just Ernest?  Given he was born late December it's likely his birth was only registered after Christmas

On his son's birth cert he is just Ernest but on May's death cert it is stated she is the widow of Ernest John Nicholls

There is no birth registration for an Ernest John Nicholls between Dec qtr 1907 and March qtr 1908

There is an Ernest Nicholls reg in the March qtr 1908 Walsall

I wonder if he was illegitimate and registered under a different name.  Possibly adopted or his mother married and he took his step fathers surname - just a thought

There are 4 Ernest Nicholls on the 1935 ER all accounted for in 1939. So it doesn't appear he was in B'ham at least up to that date.
Doesn't help does it.

If I was you I would get the birth certificate of the plain Ermest Nicholls whose birth was reg'd Mar.qtr.1908 Walsall (the only likely birth entry) to see if that matches the birthdate you have of 18/12/1907.   He was plain Ernest on ER and plain Ernest when he died). If it does at least you will be able to research the family as it certainly doesn't look like he and Dorothy May Ashby married (perhaps he was already married so not free to marry again).
