Scargill family of St Giles, London

Hello Listers
Requesting any information regarding the Wills John Scargill, Solicitor d 27 Jun 1848 London and his wife Mary Scargill (nee Chapman) died 1882 St Giles.

Would like to know if there was any mention to their children.

Son Frank Chapman Scargill b1836 d1919
Son Walter Kennedy Scargill b1838 d1871
I found out through the census that there was a daughter to their marriage
Dau Jessie Mitchel Scargill b1845 d1899 (married to Samuel Robert Bird)

for Rev. John James Scargill, died 1919, Bromley, Kent.

Hi Rosalie

The only son mentioned  in the 1848 will is John James who, it is stated, is fully provided under his mother's will so has no specific bequest.

Wills after 1858 are only available from HMCTS. If you Google that and Probate Search you should find a link to the site where you can freely search the Probate Calendars though the actual will costs £10.

I can provide a bit more detail once I'm at a computer rather than using a phone

He was a son by a previous marriage of John Scargill.

Here's the link for the HMCTS Probate Search

https://probatesearch.service.gov.uk/#wills

You'll first need to click on "Wills and Probate 1858 - 1996", type in Scargill and the year (although it says Year of Death, it's really Year of Probate). You can then click on the Next Year / Previous Year in case Year of Probate isn't year of death. After that, you can then, if you want to, order the will (but don't spend your money if it just says "Administration")

Just in case the above instructions are confusing, I can tell you that there's definitely an entry for Frank Chapman. Let me know if you can't find it

As to John Scargill's will, he was of 22/23 Montague Place and Russell Square, Middlesex, Gentleman

As to his other children, he confidently leaves it to the entire discretion of his dear wife and so leaves the entire estate to her and makes her sole executrix

He asks John James to release his estate from any claim he has under his Grandmother Ro[????]'s will, I think because father John spent £50 a year  renovating property.

I can have a go at a full transcription if desired, it's quite short.

Thanks so much Steve.... having a look through the Probate Search and finding more!
I couldn't locate Frank Chapman Scargill (he died in Ireland) but will have another look tomorrow.
He had a tribe of children!!!  Very prominent in Luton area when married to his first wife.   Anyway will look at it soon.

Don't forget the Probate may not have been granted in the same year as the death occurred

I appreciate this is a late posting on this thread but just thought the following information may be of interest:

Frank Chapman Scargill died 27 Sep 1919 aged 82 at Beaufort House, Killarney. Probate was granted at Cork and sealed at London on 23 Mar 1920 with his estate in England valued at £4267 6s 6d. His widow Constance Mary (nee Landey) was appointed executor - she died at Dun Loaghaire on 4 Apr 1963 aged 84.

Going back to John Scargill, it was Grandmother Redford who was referenced in his will proved in 1848. This refers to Elizabeth Redford, mother of his first wife Mary Catherine Redford who died in 1830. Elizabeth survived her daughter and was living with John Scargill at Burton Crescent in London at the time of her death on 14 May 1833 aged 68. She made her will in March 1831 which was proved at the PCC on 25 May 1833. Son-in-law John Scargill was appointed executor and grandson John James Scargill was to benefit from her estate from the age of 21 onwards (1849). John James Scargill died 4 Feb 1915 aged 86 at Streamlet House, Bromley. His will was proved at London on 18 Mar 1915 with his estate valued at £1375 12s 8d - brother-in-law Samuel Scargill-Bird was appointed executor. Mary Scargill, wife of John, died at 51 Gower St, St Giles on 9 Oct 1882. Her will was proved at the Principal registry in London on 9 Nov 1882 with her estate valued at £8808 16s 5d. Son John James (then living at 84 High St, Islington) and nephew John Mitchel Chapman were appointed executors.
