Scottish marriage records
« on: Monday 20 March 17 11:10 GMT (UK) »
I am new to Scottish research, and hope someone can help me with a query concerning marriages.

David McFarlane was born 1850 in Ceres, Fife, to Thomas McFarlane and Margaret Beveridge, who married 20 Oct 1839 in Strathmiglo.

In 1851 census, Margaret is in Bridgend, Fife
Margret McFarline, 42
Margret Keay, 18
Elizebeth Keay, 15
Margret McFarline, 8
Bettsay McFarline, 5
David McFarline, 10 Mo

A Margaret Beveridge married Francis Keay in Strathmiglo, they had children, including Margaret 1832 and Elizabeth 1836.

So my query is, if someone remarried, was it under there maiden name, rather than previous married name? I think this is probably the same Margaret, but unsure.  Have not found a death/burial record for Francis Keay.

Legally in Scotland a woman retains her birth name throughout her lifetime  and where other events e.g. Marriage adds another layer this is usually added as "or"  e.g. Margaret Smith marries Fred Brown and is thereafter legally known as Margaret Smith or Brown. (Even today)

Depending which part of Scotland it was also very common up until the latter part of the 1800's for widows to revert to their maiden name it is also the reason that many women are listed on gravestones under their maiden names even if alongside their husbands

Thank you very much for that.  I think then it is reasonable to assume that they are one and the same person then.  Another problem sorted out.
