name you are born and marriage diiferent

Hi wondering about my great grand mother. Here name is Annie hurley from what I have been told and seen on census records but just found out her last name was really doocey. I am wondering if their marriage is legal or not  thank you

Hi Shels,

Maybe if you give some indication from where her surname appears as Hurley (sources & dates) to when you find her name differing that will help researchers?

From what you have posted so far, no-one is going to be able to give any comment as there's nothing to relate to apart from 2 different surnames.

Dates/places/parents/husband/marriage etc. are a big help for others to help you.

All you can tell is best to give some clues  ;)

If you can provided details of marriages & births (with dates/places/all info. on them) this may solve the question but it looks as though there may have been 2nd marriages &/or illegitimacy but without further details it's hard to say for sure?

Provided a name is not changed in order to defraud (which includes escaping debt), any change is perfectly legal. So yes their marriage is legal.

Annie there was about 9 kids and she was one of the last kids born and at least 4 of them change their last name  to the mother maiden name. When the name change happen no knows. I do know they were with the irb. She was born in 1800's and married in 1906.

Let us be clear, fraud is a legal "catch all". Although the vast majority of cases involve financial concerns, that is not (by a long way) the only scope of fraud.

One can defraud another of their good name, reputation, possibility of advancement, or standing in the community. Different types of fraud often have different names in law.

If the marriage was bigamous, then she was defrauding her first husband of the comforts of that marriage.
