If one party of a marriage deserts the marriage, then in the 1960s and earlier, the sensible course of action would be to seek a dissolution to the marriage on the grounds of desertion.  Desertion was a valid reason.  Not all divorces were based on finding proof of the adultery of the spouse.  :)

Re Presumption of Death .... each state/territory has legislative power to make laws that are effective in their jurisdiction, but for example in NSW, in the 1960s it could be an action in the NSW Supreme Court, Probate division, dealing with a possible deceased estate that would require the Court to determine if a declaration can be made presuming death and therefore appoint an administrator or prove a will etc to administer the deceased estate. While the seven year rule would be a significant consideration, an action in the Supreme Court does not need to wait 7 years, it can commence as soon as the legal team representing the applicant is ready to proceed.   Also a NSW Coroner may well make a similar determination depending on evidence presented.

No Fault divorce dates from 1975-6 and is dealt with via a Federal Court, and the states ceased handling divorce cases once that arrangement was finalised.

Hi, Dorothy died one year before Ronald. It states he was married at age 38 yrs to Dorothy up to him passing. I have looked at years around it but there is nothing.

BJ Brady , no relation it says . He lived in Gordonvale where Ronald died.

Yes..
Well, the point I am making is that the informant may offer completely incorrect information, based perhaps on his beliefs about the deceased, not on actual fact.

Or, if there were children from a union, they may have misinformation about their parents marital status which is passed on.
