From what Ian has found it's quite possible that your man was crew. If he fell overboard you would think it would be mentioned in the crew list agreement, especially as the Agreement has a section entitled...

but you might try asking for a lookup of the following ... not sure if it's a crew list or just details of the vessel... I suspect the latter
