Photograph could possibly be Captain Cephas Howard born in 1834 or Private Cephas Howard born in 1880 and in the 1st Batalian Cheshire Regiment.

What is the rank of the uniform and what regiment, division or batalian?

WW1 era. Certainly not a captain and not someone born in 1834. I think this is your private from the Cheshire Regiment. See badge

Cap badge is the rearing horse of the Royal West Kents not the Cheshires who had an 8 pointed star as shown in link.
