James Dust, died 1847/48 Tasmania

Hoping someone may be able to help.
I recently found some newspaper notices regarding James Dust, band master 46th reg. died in Hobart in about 1848. Persons knowing anything of above are requested to communicate with Mr. John Williamson, Solicitor, Williamson's Chambers, 163 King Street, Sydney. Expenses paid.

There is also a shipping arrival for James on the Thomas Lord 20 Sep. 1847 from NZ to Tasmania. Another paper report is his daughter getting married which we knew about.

A few days later James' wife Agnes and their three children left NZ for Sydney on the Commet. Presumably looking for James.

What I would like to try and find out if James died in Tasmania how can I prove this. There does not seem to be a record of his death or burial.

Also would be interesting to find out who contacted the Solicitors. I assume it would be his wife. Would anything from that period still be around if so where might I find it.
All long shots but worth a try.

Any help would be much appreciated.

There is a marriage notice in Trove, from 1861, for one of his daughters - it doesn't say he's deceased.

You might expect the marriage notice to identify him as the late James DUST?


This is the notice, looking for James DUST.......only one notice, in one newspaper
 that I can see....any others? Not much effort to find him...or about him....

There is a death in Victoria for a James DUST, 75 years of age, in 1875. The inquest is reported here:

A tree on Ancestry for this man gives his children as Elizabeth, (unnamed), Emma and Edwin. It states he died in New South Wales, but gives no date or reference.

HI all a bit more about James Dust,
Our James was in the 46th regiment of foot.
He bought his way out of the regiment 1840, in Gibraltar, he and his family left Gibraltar for England about 1840/41 though I can not find them on the 1841 census which means they must have arrived just after the census.
They had three children. Elizabeth was most likely born in Dublin while the regiment were stationed there. Emma was born 1841 states on her birth certificate born in Devon. We suspect she was actually born in Gibraltar and registered in Devon once they arrived back in England.
James his wife Agnes and the two girls then sail from Devon on the Blenheim to New Plymouth NZ 1842. It is in New Plymouth that the son Edwin was born.
James moved from New Plymouth to Wellington where he was on the Jurors list, he was a storekeeper in Wellington early 1840's.
Some time ago I found his wife Agnes leaving Wellington on the Comet arrived Port Jackson 15 Oct. 1847. We thought perhaps James had died in Wellington and Agnes decides to head fro Australia for what reason we didn't know at that stage. Of course we now know she headed for Australia because her husband had gone there.
The next record I have for Agnes is getting married in Sydney to Edward Geary. 5 Jul 1848. On the marriage it stated she was Agness Bradford or Dust of Sydney widow.
When Edward died Agnes then married William Brown in 1858.
Agnes died a pauper at the Hyde Park Asylum 19 Jan 1882 she was buried at the Necropolis cemetery.
The children Elizabeth married as started in the reply. Emma married William Ransome Gullick of Waverly, Sep. 4th 1866. I have quite a bit of info. on the Gullick or Guttick family.
Edwin Dust or Geary married Annie Lillian Langley 14th Oct 1873.
Edwin died 8 Dec. 1885 I also have his probate. He is buried at Necropolis.
Emma died NSW 1891 and is buried at Burwood cemetery.
The notes on Elizabeth's death elude me at the moment I do know I have a copy in another folder.
We have all the info. on the children.
The death of the James Dust in Victoria I have his death certificate. It is possible that our James went to Melbourne for some reason and died there. Our James on the Blenheim was aged 33 in 1842. He could have lied about his age to make him seem younger to be accepted to come to New Zealand. We don't have anything else with his age on it except the Blenheim's passenger list.
Unfortunately the death certificate had no information about a wife or children. So it's either is or isn't him.
We do know in 1858 Edwin Geary/ Dust was a minor and a family friend here in New Plymouth was making a claim on behalf of Edwin for land that James had purchased in New Plymouth 12 May 1858 but the claim was disallowed.
The purchase had not gone through.

Just another quick note about the Dust's.
Agnes could not read or right. This is proved when she registers her daughter's birth in Devon. It has her X mark.
James on the other had could read and write.
We have letters written by him from Archives in Wellington where he is writing to an agent in New Plymouth asking for flower for his store in Wellington. Of course it should have been flour.

There is a shipping note from the Melbourne Argus, 26th September 1850, containing the arrival of James DUST from Hobart.
