It turns out Horace was baptized at Ninfield, 27 Dec 1840
Parents Walter Benee and Rebekah Waters
abode Ashburnham (but it says Mountfield under her name)

The licence may have been part paid for by the Burwash Overseers?

It's such a tight timetable from that  warrant, 1 April 1817, to the mariage by licence, 4 April 1817.
The child could have been born in those few days, but in the circumstances they may have had to delay the wedding a little bit? Although there must have been some pressure from the Burwash overseers.

Personally I think that Morris baptism might be a possibility!
It seems to be a complete one off for those parents, at least in Mountfield. There is a transcription error on FamilySearch with the mother's name, it is definitely Susanna, but it does say Morris. Other than that surname everything else fits.
There were certainly lots of Waters in Mountfield, so if it was a mistake I don't know how it could have happened.

They had more children than that Phil and Emily was born 1844, age 6 in 1851 Census.

I am also a bit confused with Trees have Emily Elizabeth, with Parents John/Mary Tolhurst arriving in Australia 1858 age 13 ( the record does exist for that arrival)
She arrived with Jesse 36/Etty E 33/William 16)

If the one I listed on 1851 Census is still in Sussex in 1861 how could she have immigrated 1858 and married in Australia 1862?

Family history gets very interesting the further you dig down

I am hoping I will find a Mary tolhurst death about 1851 to 1852
As john seems to have married a charlotte driver 1852

It's possible however that there was never a marriage of john to Mary waters

Mary is a likely relative of my wife's family ( the waters )
