Have you considered she may have died in the period between the arrival of the TICONDEROGA in Nov 1852 and commencement of civil registration in Jul 1853?

I see the first birth registered in Vic to this couple was at Koonong Creek in 1855. 

Do you have either of James or Harriet's death certificates?

I've searched my Vic CD for the period and I cannot see a death for Emma.

I've attached her 1842 baptism for your records.

As usual, your suggestion is probably correct that she died before civil registration began.  I haven't got the death certificates of the parents as Emma is just a distant "twig" on my tree who has had me baffled for a while.

Hi I just saw your post on Emma Maggs - my great great grandmother was Emma Maggs.  She died in Sydney Australia on 16 February 1923.  She was married to Albert Gale - married in Bristol UK in 1860.  About six years ago we found their grave in Rookwood Cemetary Sydney.  Have a beautiful photo of the grave.

Her son, Albert Morley Gale was my mother’s grandfather.

Emma (nee MAGGS) and Albert GALE are still in Bristol in the 1861 census (mistranscribed with surname as Gate, but obviously GALE on the image)

Barton Hill, Bristol St George

Emma Eliz GALE   5/12, b St Georges Gloucestershire,

The household listed just above this couple may be the mother of this Emma, or at least some relation.  Households can be listed separately even if they are living in the same dwelling - eg, as in this case there is a widow and her son (and servant) while what may be her daughter and son-in-law listed as a separate entity.

Sarah MAGGS   61 Head, Widow, Market gardener, employing 9 men, 3 boys, 1 girl, b St George Gloucestershire
Joseph MAGGS   18, son, market gardener assistant, b St George Gloucestershire
Elizabh Andrew   61, servant, cook, b St George Gloucestershire

The 1851 census has this Sarah MAGGS with her husband William MAGGS, occ market gardener, at the same address as 1861.  The Emma MAGGS married to Albert GALE gave her father's name as William.

Seems to me that this is almost certainly not  the same Emma who came to Melbourne in 1852 - she is shown in 1851 with her family in Clutton, Somerset and listed as born Clutton (this census entry leaves blank the place of birth for all of the family except James.  I would assume then, that they were all born Clutton, especially as Jamjar has given this birth reg index
