Help needed to decipher information taken from a 1780s Scottish marriage record "Penalty of forty pounds......?   And what this actually means

forty pound 'Scots'? in case of  ??  (Think there may have been different currency - still is isn't there?)

Penalty of forty pounds Scots in  Case of Failure*

Scots pounds were of different value to English pounds.This was as a security in case the marriage didn't take place.

The 'dot/tittle' is in an odd place for failure isn't it - that was my first thought, but    :-\

I think it's a Scots word meaning Failure - failrie?

By the time this document was written (1780), the union with England had taken place and the 'old' pound was only used in accounting.
