What name and occupation does he give for his father on his marriage cert? - you have an exact date so I assume you have the cert.

windy as lizdb says
do you have the marr cert and if so what is the fahers name and occ also what is james occ.
as for the term son in law i think i am right (but not positive)that it means stepson.

Sounds right then.

son in law usually means step son
So probably Mary's from a previous marriage.

I cant seem to get my head around the marriage in 1844,i have james and mary in 1862,and mary was born in 1841.
sorry if i'm not making sense

if you are talking about the marriage between john avery and mary cross
in 1844
mary cross (if we are right) was the mother of james turner.
i think you may be getting mixed up with the mother and mary born 1841 who was james's wife.

,i have james and mary in 1862,and mary was born in 1841.

What do have for 1862?

The wife of James in the 1851 census, details above, was age 43 in 1851.
It appears from the info that has been found that she was probably the mother of James Turner Cross (Iwonder if his dad was a Turner and that is why when older he used that surname? Without the marriage cert we do not know if she was single or a widow). She then married John Avery in 1844 and they had Mary, Sarah and Thomas of their own, appearing together as a family in 1851.

ooh just seen , Wozzle has sorted this too - yes in your first post you said James's wife (nee Rook) was born 1841.
Mary (prev Cross), born about 1807, who married 1844 is (possibly) JAmes's mother.

The 1841 census for Appledore, Northam shows:
Market Street
Henry ARNOLD 22 Mason born Devon
Fanny ARNOLD 32 born Devon
Mary CROSS 30 born Devon
James L (?) CROSS 1 born Devon
Susan OATWAY 20 born Devon

A George & Ann CROSS both aged 65 are also shown at One End Street.

Northam Baptisms:
18 Jan 1840 James Turner CROSS son of Mary CROSS, Spinster of Appledore
5 Oct 1806 Mary Ann CROSS dau of George & Sarah CROSS

So sorry, but your James appears to be illegitimate - I would guess that his father's last name was TURNER.

Glad it helped. Just a suggestion for future Devon based queries - always check GENUKI's pages for the parish of interest - there you would have found the census, baptism, marriage & burial records - all for free. Go to:
http://genuki.cs.ncl.ac.uk/DEV/Northam/index.html

Thanks for the Genuki's address,I do'nt think i have that detail info for my Welsh ancestors on the glamorgan genuki so i did'nt think to look on the devon site, but i think you can buy them on disc not free.
At the moment i'm learning where i can find out all the things you already know, so thanks for helping me.
