Aberdeenshire / Aberdeen Sheriff Court Paternity Cases Now Online

Just a quick note to let you all know that our volunteer has finished indexing what remains of the extracted paternity decrees in the Aberdeen Sheriff Court and they are available to search on www.scottishindexes.com. We have now completed indexing the extracted decrees held by the National Records of Scotland (NRS) for Aberdeen Sheriff Court. The years covered are 1834-1837, 1875 (2 cases only) and 1903-1916. Sadly the volumes in the intervening years are not held by the NRS and do not seem to have survived.

If you are looking for a paternity case (or other Sheriff Court case) before 1860 there are of course the processes. These are the paperwork of the court and are very interesting but are laborious to search. As with all our records the index is free to access and we give the NRS reference, you can take that reference and look at the full entry for free in the NRS.

What can you search on www.scottishindexes.com?

Over the last few years we have been steadily increasing the collections on Scottish Indexes so we thought it may be useful to summarise what we have available.

Pre-1841 Censuses and Population Lists
These have less information than the 1841 census but can still be useful. We have some pre-1841 census and population lists from the South of Scotland.

1841, 1851 and 1861 Census
Our site gives you free access to 471,001 entries from the south of Scotland and in many cases links to the location of the house on modern and historical maps.

Mental Health Records
We are working to index records from the ‘General Register of Lunatics in Asylums’, which covers all of Scotland, as well as the ‘Notices of Admissions by the Superintendent of the Mental Institutions’, which also covers all of Scotland.

Prison Registers
We have indexed most prison records for the Scottish Borders as well as many in Dumfriesshire. We are now indexing records from all over Scotland. We have indexed 18,785 entries so far.

Sheriff Court Paternity Decrees
These are an invaluable source to trace the fathers of illegitimate children in Scotland. So far we have indexed 14,703 entries from the sheriff courts of Aberdeen, Airdrie, Dumfries, Duns, Edinburgh, Hamilton, Hawick, Jedburgh, Kirkcudbright, Lanark, Linlithgow, Paisley, Peebles, Selkirk, Stranraer and Wigtown! More records are added most weeks.

Non-OPR Births/Baptisms, Banns/Marriages and Deaths/Burials
We have been indexing BMDs which are not on the ScotlandsPeople website. We have 7,325 entries in the Births/Baptisms; 1,531 entries in the Banns/Marriages; and 2,583 entries in the Deaths/Burials.

Kelso Dispensary Patient Records
This is one of our favourite record sets as it shows times in our ancestor’s lives where they were struggling but given a helping hand by those they knew. The index so far covers the first volume, for the period December 1777 to May 1783, but we hope to add more data shortly.

Register of Deeds
The Register of Deeds index now contains 1,072 entries from across Scotland.

Register of Sasines
Our index so far covers the Particular Register of Sasines for the counties of Roxburgh, Selkirk and Peebles for the year 1780, as well as covering entries from the General Register for the same counties in that year, but we hope to add more months and years shortly.

Over the past few years, with the help of a volunteer, we have been creating an index to ‘paternity’ cases found in the Sheriff Court records. These are court cases where (usually) the mother of an illegitimate child takes the father to court to prove paternity and force him to pay maintenance, or aliment for the child. We have now indexed Linlithgow Sheriff Court records from 1860-1916.

Our index is free to search and you will be given the following information:

Pursuer’s name (usually the mother)
Defenders name (usually the father)
Year of Child's Birth
Year of Decree or Extract
Sheriff Court
NRS Reference

The NRS Reference would enable you to look at the full entry for free in the National Records of Scotland.

As you can see from this example, the index entry itself can be very useful as it is not unusual to see the father’s name of the pursuer (i.e. the name of the grandfather of the child): http://www.scottishindexes.com/courttranscript.aspx?courtid=41004008

We have gathered information on each asylum including the alternative names that it was known by, where it was/is located, where the records are now and some of the history of the institution.

If you are trying to find farm locations we have linked the census to modern and historical maps to make finding your ancestral home easier. We have done much of this area; here is Cossarshill: http://www.scottishindexes.com/51transcript.aspx?houseid=77401010

To search for other place go to the home page and put the placename in the keyword box, leaving the name blank then from the search results select a census entry and you should be able to click through and see the place on the maps.

Dear Stewart,

This is very interesting. Is there an note to an RCE on the 1872 birth certificate?

Isabella took Peter McGhie to court and the court found that he has the father of her child who was born 27 September 1872. You can see an index entry to the case here: http://www.scottishindexes.com/courttranscript.aspx?courtid=15034162

In theory all these cases should have resulted in a 'Schedule F' being sent to the GRO and an RCE made in the records. We are keen to work out how often this didn't happen. It is therefore also interesting that the marriage says 'reputed father' as the court found that he was the father.
