Cornish Will
« on: Wednesday 26 January 11 20:57 GMT (UK) »
Hi,

Can anyone on here help me with a will that i am trying to understand?

http://www.cornwall-opc.org/Records/parishes/A-D/bodmin_indenture_1873.php

It was written in 1873 in Cornwall, it's called an "indenture".

Written by Bennett Michell for his grandchildren.

Any help would be appreciated.

Cheers,  Bob

If you go to the bottom of the indenture you will see a reference to a chap called Malcolm McCarthy. He has a lot of these documents and may be able to help.

If there is no link there Google his name.

I don't know if this helps.

According to a book on genealogy, an indenture can be similar to a deed for transferring the title of, or the sale of, properties etc. Originally there would be two copies cut in two with an indented, or wavy line, to prevent alterations - i.e. both copies should fit together.

The sale/transfer might be by trustees or executors and refer to a will.

The actual wording of the indenture is very complicated but the list of properties tends to suggest that this a transfer of interest in the properties, in conjunction with a will.

Hi David, I agree the wording is incredibly complicated which is why i posted it

So you think that this is not a willl, just an indenture about the property

In that case i need to get the will from York?

I think that is the case - i.e. needs to be read in conjunction with the will.
