James charged with obtaining a cheque under false pretences. 
Subsequent reports say the accuser didn't turn up for the final hearing so he was discharged

So these articles indicate that Mary Eliza is alive for those years... and her sister's marriage notice indicates that she wasn't around in 1876?  Just thinking out loud :D

No, her sister's marriage notice says she is the youngest surviving daughter (there was another younger one, Rhoda who must have died) 
That phrase does not preclude the fact that there is an older sister living.  Just means Miriam is the youngest of all the daughters still living.
