Yes, one would expect it to be Mary Tavy.

There were so many John's born in devon at the same time, I know of at least 3, different parents, even Ancestry has them confused. Thats why I thought seeing  the John/Warne marriage might show his father, clear it up once and for all.

I would suggest he was the John baptised 1812 Ashburton, son of Sampson and Elizabeth.   Sampson not a common name for the time especially coupled with the surname Nankivell, and I note that John and his wife named a son Sampson.

As to stating birthplace as Mary Tavy on 1851 census, the information may have been given by his wife rather than he himself and she assumed since they met and married in Mary Tavy that he was born there too.

Sampson Nankivell aged 54 (bc.1781) buried Ashburton 7/12/1835.
