This just in from New Zealand!

Born at St Martins Guernsey Island, Mrs. Tebbutt came to New Zealand with her husband, Mr. Robert Tebbutt, in the ship Monte Rose about 50 years ago. They landed at Auckland and after staying there for about 3 weeks, proceeded to the Whangarei district, taking up land and farming at Opuawhanga. Mrs. Tebbutt is enjoying fairly good health (aged 91) and she reads without the aid of glasses. NEW ZEALAND HERALD, VOLUME LXXII, ISSUE 22069, 27 MARCH 1935

She died there on September 1st 1935: headstone photo on Find a grave.

A case of bilateral bigamy then?!?  Unusual, but not unknown.

Putting my civil law hat on, the evidence presented here would satisfy the balance of probabilities (ie more likely than not) that is the case. Obviously it wouldn't pass the "beyond reasonable doubt" test without the paperwork and perhaps other testimony.

Divorce in those days would have been expensive so this sort of thing was not unusual  :)

Also a side issue that could explain why the Tebbutts went out to New Zealand (and not to escape the possible marriage issues). It may be that one or both of them suffered from  pulmonary tuberculosis and New Zealand was considered "a health resort for consumptives" in the 1880s.

This is a good read:

1880-1914

Sarah Tebbutt it seems was in London for ten years before she married Joseph Bryan and had three children by him. There is a tree on Ancestry that has  the 1861 census with her and Joseph as man and wife in Finsbury.
