Crime and Punishment in York

Hi

I have found a record of a William Peniston showing he was found guilty of horse stealing, (1833), and given life imprisonment. This can be found on Anc.com. I seem to remember reading that sometimes these sentences weren't carried out or were commuted. Can anyone enlighten me more? This has stemmed from a post which i have given a link to below, if anyone can help me with both posts i would be indebted to them

He was sentenced to transportation for life and was sent to New South Wales on the ship Neva in 1833. Ticket of Leave 1843, permission to marry 1846 (Catherine Crawford), pardon 1847.

Yesterday i did track down a 1833 newspaper court report which appears to be the same trial and gave his age as 20. Pity that as my Wiliam Penistone was born 1816.
