It states quite clearly against the photo: "Photo by English Heritage/Heritage Images/Getty Images".

So it would appear that you (and your family) don't hold the copyright?
Just because you assume it's your relative doesn't mean you have any hold over the image.

Are you implying that you have copyright over images of your ancestors?

It seems to have been there a while.

It is quite possible that there was more than one print so I'm not sure that you have any rights over it at all. Can you prove that the image that is on the Getty site is a copy of yours?

I think  a thorough read of copyright laws for artistic property rights (which includes photographs)  is needed.

Maybe its just my view, but surely if its been 'stolen' from you that implies you no longer have it - and you do.
You have not suffered any loss.

again just my view, but my reaction would have been to wonder if that site would be able to tell me the original source of the photo and possibly put you on the trail of hitherto unknown distant relatives who may have some great info to share.

The photo was taken by Henry Taunt, who died in 1922. He was quite a well known photographer.

The original copyright would have been with him and his heritors for 70 years after his death.
