what I am trying to prove is that the daughter Eleanor  Smith was the Eleanor Smith( Father Richard Smith of Merrington was the same one that married Thomas Cooper (Cowper)1797 Painshaw Houghton Le Spring. Would it be possible to still keep the daughters name as smith in her will written 1824 Thanks lnr

There's a burial at Merrington, 9 April 1852, Eleanor Smith, age 81. Abode Merrington.
And the North East Inheritance database has a will listed for her, died 4 April, will proved 14 Oct 1852.
The will is on FamilySearch, Eleanor Smith of Church Merrington, Spinster

So I am afraid you can probably rule Richard and Jane's daughter out as the lady who married in 1797.
