Under armed service rules you are tried twice for a civil offence.   The civil courts deal with the offendant as well as the the services (here the army).

He lied to get in the army as the KR's para 1805 covers the time before he became a soldier. The army judged him and found him guilty and punished him and part of the punishment was a dishonourable discharge. The civil courts would also give their verdict and punish him.

Service personnel are told this when they join up. You are under 2 juristrictions, civil and service law.

Hi medpat,
Thank you so much for all the information, I wonder what he did will trawl through old papers and see if I can find some thing about it, well he went  to WW1 serving in France and survived  WW1,
