306 men were “shot at dawn” in WW1 and eventually pardoned in 2006. They are remembered in a special memorial at the National Memorial Arboretum. I am researching the Scottish men from Scottish regiments.

The circumstances of their Courts Martial are clear and reasonably well recorded, but there are a few that are proving a problem in terms of finding where they were born, who their parents were etc. Service Records are missing, so one avenue is to ask if anyone has direct knowledge of any of these men, who are –

Private James Archibald, Royal Scots, was employed as a Plumber before he enlisted on 8 June 1915. He named his next-of-kin as his sister, Mrs Elizabeth Gray, 9 Rosevale Place, Leith. Private James Archibald was sentenced, after trial by Field General Court Martial, to be shot for desertion and the sentence was duly carried out on 4 June 1916. 

Private Peter Black, Black Watch (Royal Highlanders), already had a suspended sentence of death for desertion when he went missing a second time just before going into action. His absence lasted for a month and, after Court Martial, he was shot on 18 September 1916 near the border between France and Belgium.

Private (William) Peter Cairnie, Royal Scots Fusiliers, died 28 December 1916

Private Thomas Docherty, King's Own Scottish Borderers, died 16 July 1915, age 20

Private Andrew Evans, Royal Scots Fusiliers, died on 6 February 1915

Corporal Charles Lewis, Highland Light Infantry, died 11 March 1916

Private John McQuade, Highland Light Infantry, died 6 November 1916

A little bit here that might help regarding James Archibald:

In January 1915, James Archibald, from South Leith, declared himself to be 19 years old when he enlisted in 17th Battalion, Royal Scots.

So he looks to have likely been born mid 1890s, possibly Midlothian (Leith area?).

There is one marriage showing on SP/Edinburgh in 1896 for an Alexander Gray and an Elizabeth Archibald - the only Gray/Eli* Arch* marriage showing between 1895-1915 in the Midlothian area. This marriage year makes it trickier to connect Elizabeth as a sister to James on the 1901 census as Elizabeth married by now  :-\

Some information on the web has Andrew Evans age 41 , a reservist when recalled in August 1914

Thanks. One of the books on the subject also says he was a Reservist. Looking at Census details using his age, I am beginning to think he was Welsh.

That's a cliffhanger! But...?!

Regarding that single Midlothian marriage for an Elizabeth Archibald to a x Gray (Alexander), the one that showed in 1896, this is her birth entry https://familysearch.org/pal:/MM9.1.1/FQCZ-Z2Z This Elizabeth is also the only death showing in later years on SP with those names (1964).

This looks to be her in 1881 - everyone born in Edinburgh:

I think this family in 1891, likely Elizabeth out working?

There is a birth showing in 1895 for a James Archibald in Canongate to try and confirm further. There is also a death for mother Mary Forster/Archibald in Canongate in 1897. The 1911 census shows a likely entry for the James above in South Leith, aged 15 (692/02 013/00 009) which would be worth checking to see whether it will help tie things up. This is the only entry in Midlothian for a James in his age range so looks promising, together with the South Leith location which would fit well with the enlistment paper location.

Father William Rafferty Archibald looks to have died in 1902 in St Giles district of Edinburgh. Explains why sister Elizabeth would show as next of kin on his service papers. Given he would have been only around 7 when father died (if we have the right family...), likely sister Elizabeth brought him up and why he showed her address as his residence, also on his service papers.

Likely entry for sister Elizabeth in 1901:

Elizabeth Rafferty Archibald born on 20 Sep 1874 in Edinburgh to William Rafferty Archibald and Mary Forster.

Thanks for all that which is certainly all I need for that young man.

These Courts Martial certainly reveal the attitudes of that time - some of the guilty verdicts were arrived at after only 15 minutes of a trial.

Having read some of the material and young James' service papers, have to admit to being left quite down  :-\

Measuring all of 4'11&1/4" and weighing all of 93lbs, just a boy eh...
