William Dickerson was charged.with feloniously assaulting his stepmother, Phoebe Dickerson, at Teatree Gully, by striking her with a stick on September 30. Phoebe Dickerson, aged 70, deposed that prisoner came home drunk, and without provocation rushed at and knocked her down, striking her about the head with a bludgeon. He said, "Stand out of the way, father, I'll do for her." The old man stood between them, and defendant tried to push him away. Witness rushed into her room and locked herself in. He afterwards threatened to "Floor her again," He knew what he was doing. Informant had to go to her sister's. He had threatened ".To do for her" on other occasions. The stick was that of a bullock-whip. There was no doctor in the neighbourhood. Witness was suffering from the injuries. Jane Johnson, informant's daughter, said last witness came to her house two miles distant, at 1 a.m. on Oct. 1. She said they came home very drunk; had beaten her with a stick and nearly killed her. She was very bad all day, and had not recovered yet. Blood issued from the forehead, and her head was much swollen on the top. There were also bruises on the body and hip. In defence, prisoner called his father, George Dickenson, who said defendant pushed complainant down, but did nothing else.
The cause of the affair was that witness had taken a strange man into the house out of charity to have supper. Complainant grumbled. Defendant then came in and asked what the row was about, and after some words pushed complainant down. He had no stick. Complainant was very disagreeable about money matters. Prisoner, in defence, said complainant set her brother-in-law to murder him, and he had nearly done so. Committed to the Supreme Court.
