This isn't my actual query - I just became involved - but your messages are SO interesting.

The misdemeanors of William Stoner may be the reason he and his wife separated and she wasn't a widow at all. (Having said that - we never found a marriage, but possibly she kept up a pretence of a first 'marriage' by calling herself a widow at her second marriage)

Your message does clarify why no death was ever traced for William.

Yes - interesting
As I said in an earlier post - 2 off William Stoner identified on 1841 census.
One living with John Lund, Shoemaker, in Gargrave and one living 2 doors away from Elizabeth Lund who was a servant in Skipton.

From Gargrave PR Transcript:
Baptism of William Stoner son of Tempest 21.7.1822 Gargrave
Burial of William Stoner 26.9.1847 Gargrave,
Marriage of Elizabeth Stoner, widow, Dec 1849 dau of John Lund Shoemaker.

So if William son of Tempest got sent away presumably the burial is the other one -
Can you be certain it was William son of Tempest that was sent to Aus?

But no sign of Elizabeth Lund's first marriage - a marriage of Elizabeth LAND 1844, Skipton - but male name doesnt tie in.

I have browsed BMD:MC index from 1841 to 1847 - didnt spot anything that looked correct.

So Its still a mystery.

There was another William Stoner from Gargrave but he was not Tempest's son

Hi Allans,

I am so sorry -- I forgot you had found the death of a William Stoner -- I was thinking that the certificates for both the marriage AND the death couldn't be found.

That will teach me to read things from start to finish before 'opening my mouth!

You would therefore think that, on face of it - the William Stoner who was deported doesn't seem to be Elizabeth's first partner.

William was 11st 7lbs -- brown hair --- sallow --- freckles --- small pointed nose .
Occupation listed as a brace bit maker / basket maker .
father listed as TEMPEST STONER and was dead .
Also stated that he had been in Wakefield Prison 2 years previously and that his conduct was bad .

Transported on the LORD AUKLAND 13 July 1844 and departed Woolwich 16 July 1844 .
Arrived Hobart Town , Tasmania 15 November 1844 .
Conditional pardon February 1854 .
sailed on the LADY BIRD 28 Feb. 1854 from Launceston - Melbourne .
sailed on the CITY OF SYDNEY from Melbourne - Sydney , arrived in Sydney 3 July 1854 and disembarked .
 I can't find any more records of him after this .

so - no progress
We know the William Stoner that dies was not William son of Tempest, and that
William son of Tempest deported  could stil be husband of Elizabeth Lund.

But - come to think of it - we dont KNOW that her husband was called William
only that her married name was Stoner - she married after 1841 census (if she married at all) - and remarried as a widow after William son of Tempest was deported.

I have other families in my tree transported to Aus - one of which was married (in Suffolk) before the deportation - but she married again as a widow 7 years later - legal statute permitted this, he could be declared legally dead if not heard from for 7 years, also the convict married in Aus - before the 7 years had expired.
