Help needed with latin (?) portion of 1616 will
« on: Thursday 27 December 12 13:42 GMT (UK) »
Hi
With the help of experts on here, I am able to understand the body of this 1616 will, but it has a latin (?) piece at the end which I would love to be able to understand. Any help would be much appreciated.
Thanks, John

Can't do a proper translation, but able to pick out a few words.

Believe that probate was granted with will annexed at Lincoln on
18 September 1616.

Executor may be John Hutchinson, Clerk, Curate of Spalding.

Redroger has put a translation of the common words in a Latin probate on here on a few occasions, whether it has got as far as the Help section of Roots, I don't know, but here are some of the possible phrases and English translations.

Probatum fuit hujusmodi testamentum coram venerabile viro (Name of Judge), artium magistro,
Approved was this testament before the worshipful man (Name of Judge), of arts master,

Officiale domini Archidiaconi (Name of Archdeacon) apud (Place where approved) tercio die
Official of the Lord Archdeacon (Name of Archdeacon) at (Place where approved) on the 3rd day

Mensis Augusti Anno Domini Millesimo quingentisimo duodecimo, juramento (Name of executor)
Of the month of August AD 1512, by the oath of (Name of executor) - month and year as per whichever will it is.

Executoris in suprascripto testamento nominati. Et commissa fuit administrato omnium
The executor of the above-written testament named. And committed was the administration of all

Et singularum bonorum et debitorum etc. defuncti prefato  executori etc. de bene et fideliter
And singular the goods and debts etc. of the deceased to the said executor etc. for well and truly

Administrando ac de pleno inventario exhibendo etc. ad sancta dei evangelia jurato in debita
Administering and for a full inventory delivering etc. on the holy of God gospels sworn in due form

De juris. Potestate reservata commitendo predictam administrationem ( Name), vidue, relict
Of law.
Power being reserved for committing the said administration to (Name) widow, the relict

Defuncti et alii executrici  in testamento nominate.
Of the deceased and the other executrix in the testament named.

Thanks vv and Lizzie, it certainly looks like a probate thing. I'll put Lizzies list next to the article and look for similarities.

Thanks, John

Not knowing Latin, this lacks the context I rely on when
attempting a transcription. As a result, abbreviations, word
endings, and even entire words are just guesses, so treat it
all with suspicion.  :)

 1. Probatum fuit huiusmodi testamentum suprascriptum apud Lincoln_
 2. decimo die mensis Septembris Anno Domini millesimo
 3. sexcentesimo decimo sexto Coram iuro Thoma Robinson Clerico
 4. artium magistro Surro_ venerabilis viri Christoferi Kinell legum
 5. doctoris reverendi in Christo patris ac domini domini Richardi providentiam
 6. domino Lincoln_ Episcopi vicarij in spiritualibus generalis et officialis
 7. principalis ___ officialis domini Archidiaconi Archidiaconatus Lincoln_
 8. ___ constitut ac pro valore eiusdem pronunciatus
 9. ___ ___ fuit onus executoris dicti testamenti executori
10. in __________ primitus in forma iuris Coram iuro :
11. Joh[ann]e Hutchinson Cl(er)ico Curato de Spaldinge
12. vigore Comissionis sibi in hac parte directet
13. emiss_ p(er)sonal_ iurat saluo/salvo in re ??

The question arising is why the executor nominated in the will
is not named here, whereas one of the beneficiaries (Hutchinson) is.
If the answer is here, it is probably in lines 8-10, where sadly
there are too many gaps.

Hopefully, the Latinists will rise from their Yuletide Feasting soon.  ;D

I doubt if I can improve much on veeblevort.
Line 2 is decimo octavo die so
"The above written testament was proved on the 18th September 1616 at Lincoln before me"
I don't think the word before Thomas is iuro, maybe iurato? juror?
The word in line 4 is surrogate, so we have Thomas Robinson master of arts surrogate, Christopher Kinell reverend doctor of the law and the bishop Richard
I can't get the second word in line 7 or the first in line 8
Line 9 begins commissumque fuit so
"The burden of executor of the said testament was committed to the executor in the same"
Line 10 starts in eodem, the same, but then I'm lost again, maybe "called first".
John Hutchinson priest of Spalding takes to himself in this role, having left out what is personal, takes the oath.
All corrections welcome, claytonbradley
