I found William and family on the Tasmania. No luck with Francis Thomas. I did find some Francis Thomas but couldn't pair up with a wife named either Frances or Elizabeth, but he could have come out separately or be one of the F  or Mr Thomas' listed. I notice all the Gates and Barnsleys came out unassisted. I haven't found anything further on Francis Thomas court case for assault yet, either.

. I have just found another article from the Melbourne Argus dated 20 Jan 1868 where Anne's son who was Superintendent of an orphanage in Western Australia was charged with excessive violence towards orphans. He got off because of a 'whitewash' but died of Typhoid a few years later and his son went on to become a Rhodes Scholar and Mum continued working at the orphanage.[

I cannot follow what you have written above. The only family that I can find reference to that had links to the Swan Boys Orphanage in WA and had a son who was a Rhodes Scholar was the WILCHER family.
Seems the charge against Francis THOMAS was not proceeded with.

That's correct. Anne Barnsley married Charles Joseph Wilcher and their eldest son was the Superintendent of the Swan Boys orphanage. I thought Francis Thomas might have married into the Barnsley family to be an 'uncle' but I can't find a connection to date. I wonder why Francis Thomas got off? The 2nd assault had witnesses.

OK

Found the THOMAS and GATES connection.

Found this death

1908 South Melbourne
Frances THOMAS
age 86
Father GALES Wm
Mother Ann SCOTT
BA 1822
rego 3830

Francis THOMAS was the husband of Frances GATES, sister of Ann KEMP/BANSLEY nee GATES
It seems that Francis THOMAS left his wife Frances THOMAS in Emerald Hill Melbourne and returned to England and died there in 1885.

You will find Will and Probate for both Francis THOMAS death 1885 and Frances THOMAS death 1908 on the Victorian Public Records site
http://prov.vic.gov.au/index_search?searchid=54

Samuel George KEMP is shown to be the nephew of Frances THOMAS in her will.

Great! Thank you so much Leonie. I am in the library and I used the connection you supplied and found 3 numbers for each individual but couldn't view them. How are you able to view them? Would I need to get all 6 of the wills or could I just purchase 1 for each person? Could I ask you to copy them and email them to me, please, if you have access? It seems that I would have to go to Ballarat or Bendigo to see them. Is there any way of getting the police reports on the 2 assaults on Anne? You know this line started because I thought the kids were in an orphanage. I wonder what happened to Pauline and Anne when Samuel Kemp remarried and took back his 2 children? You know the mother of Anne who was married to Samuel Kemp was buried with her 1st husband - I wonder what that meant?

Well done Leonie  ;D

Jason46, when you click on each of the VPRS links you will go to the next page with a "view record" button.  Click on that and the document will download.  Sometimes it takes awhile if the site is busy.

Hi Jason
If you have no luck downloading the will, probate records please let me know.
Do you have a copy of the Coroners inquest into Ann KEMP's death? This would contain all the police and court findings. You can get a copy from The Victorian Public Records Office 99 Shiel Street North Melbourne.
Cheers Leonie
