Latin translation help needed particularly around the word John Monckton

Can anyone read these few lines (attached), particularly around the word John Monckton.  It is a Will for Thomas Berre (Berrie). Thank you.

It's only a procedural clause, attached to the end of a Judicial Sentence relating to the will.

… in accordance with the petition of Thomas Browne, notary public (and) procurator of the aforesaid William Fox, and in the presence of John Theter(?), notary public (and) procurator of the aforesaid John Monnckton; upon the declaration of this Judicial Sentence the said Browne requested John Lawe, notary public then present, to prepare for him one or more public instruments and witnesses etc., then and there present John Deye and John Drury, Doctors of Laws, Thomas Lovell and Christopher Youle, notaries public, as witnesses etc.

Further to the excellent translation - the word "aforesaid" John Monckton led me to review the Will to find the earlier mention.  May I ask for help then with the following small extract where he is mentioned again? 
Context is: Will for Thomas Berry of Walesby Lincs, mentions son-in-law William Fox and children Eliz, Anthony, Richard, Ellen and Suzanne.  I'm trying to establish how Monckton connects - beyond him having something to do with probate.  Thank you.

John Monckton is described in the Judicial Sentence as the uncle of Elizabeth Berrie.

He was not involved in the probate. Along with members of the Bury family, he was a party to a legal dispute over the way the estate was administered. It is this dispute that gave rise to the Judicial Sentence recorded here.

The background to the dispute is not given, but the court found in favour of William Fox, the executor.
