RTL, grateful though I am for your very kind (as ever) offer, it looks like I will be able to look at the records for burials at St James myself at the FHC next time I go. 
Now that I have found the records in the catalogue I've noted it on my list for my next visit.

Hi Boo,River Tyne Lass  got me some info regarding my Gt Grandfather who was buried in the
churchyard,contacted them through their website and they were great sent a headstone photo
of the family grave etc,worth a try.

I'll hang on till I can see the burial registers at the FHC. If he's not in there I'll contact them and ask if the churchyard was open to burials for people from the RC church in Bell's Close and if so would they have been recorded in the parish register.

Unfortunately the chances of a headstone for this wee one are way less than zilch, I'd doubt if funds would have allowed for that.

Yes, it could have happened.

the Llanfrothen burial case; this established the right of Nonconformists to be buried according to their own denominational rites in parish burial grounds, a right given by the Burial Laws Amendment Act 1880 that had up to then been ignored by the Anglican clergy.

What I didn't make clear was that a Roman Catholic could have been buried in an Anglican burial ground before 1880, but they would not have been entitled to their own denominational burial rites. This was what was enshrined in the 1880 Act.

I did understand, but I need to look at the burial records first before trying other options.
I can see they would have been obliged by law to do allow him to be buried there and may well have done, but as there was a choice of civil cemeteries perhaps St James wouldn't do it unless pressured - or the RC priest may have decided he'd rather not have 'his' flock in another denomination's churchyard.
Anything is possible until I see what's in the register. If he's not in there I'll see if I can find him in a civil cemetery and then, if I run out of options, I'll contact St James. Though I am not averse to asking parishes for help if they have time to do so, I'd much rather try myself first and only ask them if I get 'really' stuck.

I will report back when I have looked at the records, but the FHC is closed for a couple of weeks as its a school holiday here and the volunteers have families who will take priority over running the centre.

It would seem that they did not only bury Anglicans there as it looks like others were also buried by a Roman Priest too.  Some I have noticed were buried by a 'Dissenting Minister'.

Hi RTL, apologies for not replying sooner. We have been away for a couple of days and only had intermittent signals and very little time to check mail.

I'll be able to get a copy of the record when I go to the FHC in a couple of weeks.

Pleased I am now sure where he was buried, I do like to know as much as I can about these wee ones born and died too soon.
