Help with latin document off waalt site dated 1416 re Thomas & William Hevyr
« on: Thursday 16 February 23 04:02 GMT (UK) »
Hi folks,
I'm hoping some kind soul could help with the attached image from waalt. The summary from the index is:
CP40/621: Easter Term 1416
"Kent. trespass: close and taking
Knok, John; Knok, Thomas vs. Hevyr, Thomas, of Cranebroke, laborer; Hevyr, William, of Cranebroke, laborer; Begynden, Adam, of Cranebroke, laborer; Page, Thomas, of Cranebroke, laborer; Broun, Richard, of Cranebroke, butcher; Cardere, Stephen, of Cranebroke, chapman;
Petyn, Thomas, of Cranebroke, tailor"

The original image can be found here: http://aalt.law.uh.edu/H5/CP40no621/aCP40no621fronts/IMG_0886.htm

I am particularly after anything it may say about Thomas & William Hevyr that's not mentioned in the above abstract and perhaps some more detail as to what the case is about. The original is damaged so unfortunately some of the text is missing.

Thanks in advance!

On the individuals named, there is no more detail than is given in the CP 40 abstract.

On the complaint itself, with standard missing text supplied in square brackets …

… in a plea whereby with force and arms they [broke into] a close of the same John and Thomas Cnok at Cranbrook and cut down and took away [a number of] their trees and undergrowth that were lately growing there, to the value of forty shillings; and they [trampled and] destroyed [grassland] that was lately growing there on which certain animals were being pastured, to the value of one hundred shillings, and other offences, etc., to the serious damage, etc., and against the peace, etc.; and they (= the defendants) did not come; and the sheriff [was ordered] to attach them, etc.; and the sheriff now reports that they have nothing (= nothing of sufficient value within his jurisdiction), etc.; therefore they are to be arrested so that they are here within [eight or fifteen days] of Holy Trinity, etc.

Thanks Bookbox .. that was more than I was hoping for ... you are a gem!

As a postscript, shortly after this case Thomas & John Hevyr received their late father's lands which had been in the hands of his feoffees. So whilst "they had nothing" was true at the time of the case, soon after they came into their inheritance and then "had something".
