Hi All,

A Google search of some of my Poyser relatives brought up the attached file held by the National Archives.

I am wondering what it would be about. As I am living in Australia there is no way I can visit the Archives to view the file

This is a what the website has

"Description:   Cause number: 1855 C61.
Short title: Cast v Poyser.
Documents: Bill, interrogatories, four answers, two sets of depositions.
Plaintiffs: John Cast.
Defendants: Alicia Poyser widow, Mordaunt Martin Monro, Henry Poyser the elder, Mary Poyser spinster (deleted) Frederick Brien and Mary Brien his wife, John Mapplebeck and Mary Mapplebeck his wife, Franz Wilhem Thelen, Elizabeth Thelen his wife and Ann Mapplebeck.
Amended by order 1855. It is the documentation for a lawsuit brought in the Court of Chancery by John Cast (as plaintiff) against all the defendants listed.

The catalogue description doesn’t provide enough to know for sure what it’s about, but it may relate to the estate of Daniel Poyser of Ponders End, whose will was proved in the PCC in 1855, and/or to an earlier estate relevant to that family. That’s just a guess.

If Daniel Poyser is of interest to you, it would be worth looking at his will, to see if any of the names mentioned in it also appear amongst the defendants listed in the catalogue entry.

If you want to see the documents, you can ask TNA for a quote for sending you digitised copies, but as the case is extensive and so many people are involved (many of whom will have provided depositions), it is likely to be quite costly, and it won’t be easy to read.

The full TNA catalogue reference, not showing in your extract above, is C 15/187/C61

Looking at the Newspapers on the site Findmypast.  There are number of articles re: this case.  In The Sun (London) 11 May 1856 it mentions in the High Court of Chancery John Cast against Alicia Poyser and others on the real estate of Daniel Poyser late of Ponders-end.    The Solicitors requested that creditors and encumbrancers attend in person to the offices of the Vice Chancellor Sir John Stuart No. 12 Old Square Lincoln's Inn to prove their debts and encumbrances before 2/4/1856.  To be decided on 9/4/1856.

TNA will copy it for you - but at a price.
You may find someone on here who will look at it for you on one of their visits to Kew.

Thank you for your replies.

Daniel Poyser died in the March quarter of 1855, Alicia was his widow. Most of the others mentioned are nieces, nephews or some other relation of his.

Of interest is that my great great grandparents Frederick and Mary Brien (nee Poyser) came to Australia in November 1856. Maybe they used some money from the estate to pay for their passage.
