Bastardy Case - c1830's.
« on: Friday 18 August 23 05:49 BST (UK) »
Hi all,

Would someone be able to check if there was a Bastardy case mentioning my man 'John GARSIDE' as reputed father.  He was born Cheshire c1810 and transported 1836.  Records show he used the alias 'SMITH'.

His court records show that he had been in gaol once previously for Bastardy, and was married with one child.  Who he was married to or who the child was I am unsure.  I'm wondering if he them married the child's mother.  At the time of transportation he was supposedly residing in Newton.

Thanks in advance.

bitzar.

Thanks for your replies.

I believe John was a Collier when transported but I only know him as of Cheshire.  A relative told me he was residing at Newton during his trial for soap stealing.  There isnt a date or year for the bastardy incarceration.

There are few John GARSIDE's about in Cheshire of the right age.

I am confused?
as far as I know there is no offence of "bastardy" which lead to a gaol sentence?

An illegitimate child was of concern to the Churchwarden or Overseer of the Poor, who were concerned as to who was liable to pay for the child's upbringing.

Failure to conform to a subsequent Affiliation Order may have resulted in a gaol sentence?

The info re Bastardy comes from a UK Prison Hulk record.  In the Gaolers comments it reads:  Once in Gaol for Bastardy.

On the NSW convict indents it does state, no other convictions!
