It is not very clear, but perhaps you mean that others with family trees think that Charles born 1794 is the father of Charles born 1829, but you don't agree.  Is that right?

I can see the 1829 baptism to Charles and Margaret although it was in Lancashire, not Birmingham where your Charles says he was born.  If that child is the shop boy living in Friargate in 1841 then he most likely died in 1844 and was buried at Preston.

I can't see anyone named Charles WINTER baptised in Birmingham around that time.

There is a baptism a little earlier in 1826 to Robert and Elizabeth in Birmingham, and by 1841 that family has moved to Gloucestershire.

1n 1871 and 1881 Charles is listed as a solder/Sargeant and FindMyPast has a record of a Charles Winter b 1830 Borsley (Bordesley?) Birmingham. 

The service record lists him as a Color Sargeant  includes service including Canada which is listed as Charles's wife Ann's birthplace in the census and his daughter Elizabeth was born in Corfu which also ties in with a posting in the army record.  It also lists his enlistment in 1847 in Bristol Glos which might tie in with the Charles that Dundee found

The family is here in 1841.

Only children Ann and Charles were baptised in Birmingham before they moved.  For Ann they were at Fazeley Street, and Charles was Bartholomew Street so they were in the right area for him to say that he was born at Bordesley.

 Bristol Glos I can now think  back  from years ago
my Cousin said something about  Bristol way
 I had forgotten all about it.
I took a wee  look on his tree but it stop 1829 same as mine 
brick wall ,
and now I can see what I can find.

I think this is the Purnell family in 1841 living at Merchant Street, St James, Bristol  before John Purnell married Elizaabeth Winter in 1846.  John's daughter is Frances was 7?

The transcription of the marriage of John Purnell to Elizabeth Winter is on FindMyPast and

John Purnell age 47 widower

I agree that the age of Elizabeth Winter/Hill/Purnell varies but she may have knocked a few years of her age when she remarried.  By 1861 she is listed as 59
