Death informant age
« on: Friday 16 February 24 16:02 GMT (UK) »
Hi everyone,

I was wondering if there was a legal minimum age for someone to be the informant on a death register in Ireland in the 1930s?

Could a fifteen year old legally register a death?

I've had a look at the wording of the Births and Deaths Registration Act, 1874, but can't see an age for the informant.

Many thanks!  :)

Yes, no age limit. As long as they were cognizant of the facts and able to inform. A 15 year old was past school age, literate, and if present at the death well qualified to be the informant.

Same applies to marriage witnesses [appreciate below are for England but effectively the same in Ireland]
1753 Lord Hardwicke’s Act,...all Marriages shall be solemnized in the Presence of two or more credible Witnesses.
Today: There is no age limit for a witness, but they must be able to understand what is taking place and if necessary, give evidence as to what they have seen and heard if they are required to testify in court.

A 15 year old could legally marry in 1930.
At the establishment of the Irish Free State in 1922 under common law the minimum age for marriage, irrespective of religious belief, was 14 years for a male and 12 years for a female - the old Canon Law ages.
The R.C. Canon Law ages were raised to 16 and 14 in 1917 but the legal ages were not raised to 16 until the (Irish) 1972 Marriage Act which did not come fully into operation until 1 January 1975.
